Dubai Business Bay Tenant Evicted Over Unpaid Dh2 Million Rent
A Dubai Business Bay tenant was evicted after failing to pay Dh2.415 million in rent despite a late payment attempt.
A tenant in Dubai's Business Bay was ordered to vacate commercial premises after failing to pay Dh2.415 million in rent over eight months, according to a ruling by the Dubai Rental Disputes Centre (RDC).
The tenant did not make any rental payments since the start of the commercial lease and attempted to pay the outstanding amount only after the legal deadline had passed.
The landlord issued a formal 30-day notice demanding payment or vacation of the property, but the tenant did not comply within this period. The RDC's First Instance Committee determined that the tenant's subsequent offer and deposit of the overdue rent came after the statutory 30-day deadline and therefore did not prevent eviction.
The committee's decision referenced Dubai Law No. 26 of 2007, amended by Law No. 33 of 2008, which allows landlords to seek eviction if rent is unpaid within 30 days of receiving a legal notice. The ruling confirmed that late payments after this period do not halt eviction proceedings.
In addition to vacating the premises and returning it free of occupants and belongings, the tenant was ordered to pay any additional rent accruing at the annual rate until eviction, along with related fees and costs.
This case underscores the importance of adhering to legal deadlines in rental disputes and serves as a reminder for tenants to respond promptly to payment notices to avoid eviction.
